Atlanta Motorcyclist killed in DUI Accident

An Atlanta Motorcyclist was riding through Atlanta last Friday when he was tragically killed by a suspected drunk driver. Paulding County Police state that the automobile driver turned into the motorcyclist's lane of travel. The driver of the automobile was arrested for suspicion of drunk driver. He was charged with DUI and vehicular homicide.
Georgia law allows for punitive damages when a tortfeasor's conduct is reckless, willful, wanton or shows a conscious disregard for the consequences of his actions. O.C.G.A. § 51-12-5.1. When a driver causes an accident while intoxicated, the issue of punitive damages for his conduct is always for the jury to decide.
