Two Days After Christmas, Teenager Killed in Pedestrian Accident

Cherokee County – It was just two days after Christmas in the early morning hours of December 27th, 2012 when a 19-year-old Canton man was walking on East Cherokee Drive near Berry Patch Road that he was struck and killed by a Chrysler PT Cruiser.

The Atlanta Journal-Constitution reported that the young man was walking southbound on East Cherokee Drive when the driver of the Chrysler PT Cruiser turned right, thus striking and killing the young man.

According to Georgia State Patrol spokesman Gordy Wright, the victim was walking southbound in the road when he was struck by a Chrysler PT Cruiser as it was coming around the curve. Following the accident, East Cherokee Drive was shut down for hours while law enforcement investigated the scene.

Georgia State Patrol Spokesman Gordy Wright said the driver of the PT Cruiser will not be charged. The family of the deceased has hired Kalka & Baer LLC to assist them in filing a wrongful death suit on behalf of their son.

At Kalka & Baer LLC, we represent both accident victims, as well as the surviving family members in personal injury claims. Wrongful death claims in particular are covered under §9-3-33 of the Georgia Code. Under Section 9-3-33, actions for injuries to a person must be brought within two years after the date of the victim's death. This is referred to as the "statute of limitations." This means that in order for the surviving family members of the deceased to file a lawsuit against the legally liable party, they must file a wrongful death claim within 2 years of the victim's death.

When a family member has been killed in an accident that was caused by someone else's negligent actions, certain family members have the legal right to file a wrongful death claim for damages. These damages are designed to cover medical bills, ambulance bills, and funeral costs, loss of financial support, loss of companionship and any other financial losses stemming from the accident.
