In 2014, a woman driving with UBER-X t-boned a vehicle which failed to
yield attempting to turn left at a busy intersection in Decatur, Georgia.
The force of the collision slammed her right foot into the firewall of
the car causing a commuted calcaneus fracture to her right foot. Essentially
her right heel was shattered similar to how the window pane of your car
might get shattered if a rock were to strike it, causing multiple fracture
lines. She could not place any weight on her heel and needed a complicated
surgery. At the time of the
car wreck, our client was without health insurance and did not have access to a
qualified orthopedic to perform the surgery.
The Uber-X driver initially hired a TV advertising lawyer with too heavy
a case load. The advertising lawyer did not spend sufficient time to understand
the severity of her injuries and lacked connections with qualified physicians
to treat this complex fracture. Thus, our client spent three months bouncing
from doctor to doctor without receiving any real treatment.
Frustrated with the service she was receiving, she fired her advertising
lawyer and hired Bryan Baer at Kalka & Baer.
Attorney Baer referred her to a top orthopedic surgeon and helped the client obtain
health insurance in order to pay for the necessary surgery while Mr. Baer
pursued the case.
Kalka & Baer performed a detailed investigation on the at-fault driver
and available insurance and filed suit. Although the at-fault driver claimed
that our client was speeding,
Kalka & Baer was able to prove otherwise. Ultimately, Attorney Baer was able to recover
$550,000.00 for the injured UBER-X driver.
Kalka & Baer’s client has since recovered from her injuries and
is now back driving with UBER.
