A Cumming man was killed in an Alpharetta car crash on April 11, 2012. An investigation into the crash was opened, and led to arrest warrants being filed. Now, authorities indicate that the woman responsible for this fatal wreck has turned herself in to police to face charges.

On Wednesday, May 16, 2012, Haleigh Davis Fine, 23, of Alpharetta, was charged with failure to maintain lane and second-degree vehicular homicide.

Authorities say that the 23-year-old was on her cell phone at the time of the fatal wreck. The crash occurred on Georgia 400 when Haleigh veered into an adjacent lane. Police indicate that her red Honda Civic hit a Nissan Pathfinder causing it to slide into a grassy gore area, strike a guardrail and rollover multiple times.

Edward Kivlin, 67, of Cumming, was behind the wheel of the Pathfinder and died at the accident scene.

Some of Kivlin’s neighbors told the media that he was a nice, quiet guy who always waved and smiled. Franklin, one of his neighbors, told the media that when “you’re driving a 2,000-pound rocket, you’ve got to be mindful on the road.”

According to the National Highway Transportation Safety Administration, about 3,000 people died last year due to distracted driving. Due to the shocking numbers, U.S. Transportation Secretary Ray La Hood is calling for an outright ban on cell phones in vehicles.

When innocent drivers lose their lives because someone else isn’t being careful on the road or is distracted on the phone, justice needs to be served. The Kalka Law Group would like to wish Mr. Kivlin’s family, friends and neighbors strength to get through this tragic time following this fatal Alpharetta car crash.
