Accidents on GA 400 Highway

In Georgia, one of the major causes of car accidents is driver negligence. The simplest of driving errors—such as texting while driving or speeding—can lead to serious crashes that can cause severe or life-threatening injuries.

Many accidents occur on the GA 400 highway each year and we have represented many individuals who have suffered injuries from auto accidents.

Common Types of Car Accident Injuries

Experiencing a car accident can be traumatic, and facing the aftermath can be overwhelming and stressful. The costs of car repairs or of a new vehicle, as well as medical expenses, can become a great burden. This is especially the case if you are unable to work after an injury, and are experiencing wage loss. Our firm is here to help you recover from such a horrible accident by recovering the compensation you need.

Our injury attorneys have represented clients who suffered the following types of injuries:

Factors like accidents involving multiple cars or uninsured motorists can complicate your case, by making it unclear who exactly was at fault in the accident. This is why it is so important to have an experienced and qualified Atlanta car accident attorney on your side that knows how to navigate these scenarios and fight for your best interests.

What Compensation is Available After a Crash?

If you are left with serious injuries that prevent you from returning to work or that require extensive medical treatment, then you will need to hold the other person accountable for his or her negligent driving and actions. If you are involved in a car crash with a negligent driver, it is important that you hire a skilled personal injury lawyer as soon as possible.

An experienced attorney will be able to explain your rights and may be able to obtain financial compensation for:

  • Medical bills
  • Physical therapy
  • Rehabilitation
  • Ongoing care
  • Loss of services
  • Loss of a spouse
  • Lost wages
  • Instances of pain and suffering

What is Your Case Worth?

No two cases are the same. Case valuation involves a complex and skilled analysis of the liability issues, causation, and damages that are unique to your case. Factors to be considered include medical bills, injuries, insurance company bad faith and compensatory damages must be carefully examined. Our team will examine all factors and promptly discuss your case with you.

We Will Deal With the Insurance Companies

In order to receive compensation after you an accident, you will need to negotiate with the negligent driver's insurance company. Unfortunately, insurance adjusters are in the practice of offering low amounts of money to accident victims in order to save their companies money.

They know every trick in the book that will help them lessen the amount of compensation they owe you. Oftentimes, an insurance company's offer is woefully less than you deserve and need for recovering from your injuries and loss.

Our lawyers know how to negotiate with the adjuster in order to secure a just and fair amount. Don't face the insurance companies alone; you need a skilled professional on your side to advocate for you.

Distracted Driving: A National Concern

The U.S. Department of Transportation has taken it upon itself to lead the effort against distracted driving, particularly texting and cell phone use behind the wheel. Since 2009, DOT has held two national distracted driving summits, banned texting and cell phone use for commercial drivers, and encouraged states to adopt tough laws, and launched campaigns to raise the public's awareness about the dangers of texting while driving.

Common forms of distracted driving include:

  • Texting while driving
  • Using a cell phone or a smartphone
  • Reading
  • Eating or drinking
  • Using a navigational system
  • Applying cosmetics
  • Adjusting the radio, DVD player, CD player, or an MP3 player

Due to the fact that sending and receiving text messages require visual, manual and cognitive attention from the driver, texting while driving is the most alarming and dangerous form of driver distraction. In 2011 alone, 3,331 people were killed in accidents involving a distracted driver, and an additional 387,000 people were injured in distracted driving crashes. (NHTSA)

Other Major Causes of Car Accidents in Atlanta

Aside from aggressive driving, speeding, drunk driving and distracted driving, other factors can contribute to dangerous car accidents, some of which include:

  • Drivers who are impaired by illegal drugs or even lawfully prescribed medications. There are some prescriptions on the market that cause marked drowsiness, confusion, visual disturbances and sleep. Common medications that cause drowsiness include anticonvulsants (used to treat epilepsy and seizures), antidepressants, antiemetics (used to treat nausea), antihistamines or other allergy medications, sedatives or tranquilizers. The sedating effects of these medications can be magnified when they are combined with alcohol.
  • Dangerous road conditions. This includes obstacles in the road (such as objects that have fallen out of vehicles), animals crossing the road, poor weather conditions such as the wind, rain, fog, ice or snow.
  • Hazardous road design or layout, as well as defects in the road that need repair. Potholes, shrubs or other objects that obstruct the view and other surface conditions can cause accidents. The causes may be subtle but repeated accidents in the same stretch of road are indications that a problem exists.
  • Mechanical failure and defects in automotive design can be a factor. While these are less common causes than driver negligence, still, faulty brakes, or a defective tire, or some other flaw in the design or manufacturing of the automobile can lead to serious accidents.

Types of Car Accidents

  • Head-On Collisions: Perhaps one of the most dangerous types of collisions involves head-on collisions. Devoid of any barriers such as cable barriers, concrete barriers, or metal crash barriers, head-on collisions frequently result in injuries because of the speeds involved in such crashes. Head-on collisions typically occur when one vehicle inadvertently swerves out of their lane and into oncoming traffic, giving either driver little time or room to make an evasive maneuver. Root causes can be linked back to a steering overcorrection after veering to the side of the road or from driver distraction.
  • Vehicle Rollovers: While these are not common, they can lead to greater rates of severe injury and even death. In many cases, rollovers are secondary events that occur after a collision with another vehicle, a lane departure at high speed or a run-off-road crash.
  • Rear-End Accidents: These collisions occur when the vehicle in the rear hits the vehicle in front. These can often occur when the driver in the rear is following too closely or when the driver in the front slows or comes to a stop and the driver in the rear wasn't paying attention and slams into the front vehicle.
  • Side-Impact Collisions: This type of accident can occur when one car hits the side of another vehicle, commonly called T-boning. These types of accidents may occur when one car runs a red light or fails to stop at a stop sign, and are common occurrences at intersections.
  • Multi-Vehicle Accidents: A multi-car collision typically begins with two cars, but can quickly involve more vehicles. Multi-car collisions can often happen during poor weather or when there is ice on the road.
  • Single-Vehicle Accidents: Single-vehicle accidents can occur when a car swerves to avoid hitting an animal or something in the road and rolls-over or strikes an inanimate object, or rolls down an embankment or into a ditch. Single-vehicle accidents can occur for a variety of reasons including a defective tire or faulty brakes. If the car or parts manufacturer was to blame for the collision, compensation may be pursued with the at-fault parties.

Answers to Common Car Accident FAQ

We recognize that you likely have a lot of questions following your auto accident and you may want to discover some answers before you begin any sort of claim or pursue further legal action.

How Long Do I Have to File My Case?

Generally, you have two years from the date of the accident to file a case for personal injury. If a minor child was involved in the accident then that child has a longer period to file their case.

Recently, the Georgia Supreme Court ruled that the time period to bring file a personal injury case can be extended beyond two years depending upon the date of the injury and resolution of the traffic ticket. This new law provides injured victims additional time to select the proper lawyer.

How Do I Obtain the Police Report From My Car Accident?

If you have been in a car accident and the police came to the scene, you probably received a copy of the accident report. The report should detail the crash, but it is not the official police report. A Georgia car accident generates the police to create a police report within a few days of the crash.

A police report is one of the most important pieces of evidence in any car crash case. Police reports contain all kinds of useful information. If one is created, then it becomes the starting point of the insurance claim investigation. You can obtain the report online or in person depending on the city or county police who reports the accident.

For example, Gwinnett County Police Department now makes it easy to obtain police reports online through for a $6 charge.

Part of having a car accident lawyer is that they can obtain your police report for you and deal with the insurance companies on your behalf. Kalka & Baer LLC has expert attorneys and has represented clients not only in Atlanta but also across the state of Georgia.

I Was Hit by an Uninsured Motorist. How Do I Pursue a Claim?

Unfortunately, there are still many motorists who drive around uninsured or underinsured. Although Georgia law requires that drivers be insured in order to drive, about 14% of all drivers are uninsured, according to recent statistics. If your vehicle has been damaged and you have been injured after a car accident with a negligent and uninsured driver, you have rights.

What If I Was Injured in a Car Crash While I Was Working on the Job?

The laws in Georgia allow a person injured in a car crash whiles working on the job to obtain a settlement from their employer’s workers' compensation insurance company AND the insurance company of the car that caused the accident. Contact Kalka & Baer LLC if this happened to you.

The Insurance Company Wants Me to Give a Recorded Statement. What Should I Do?

You should not give a statement to an insurance company unless you have spoken with a lawyer. Insurance company representatives are trained to ask specific questions that will hurt your case and harm your settlement. It is very important to speak with a lawyer prior to giving any statement to an insurance company.

You may have to obtain compensation from your own insurance company, or you may be able to file a claim for damages against the other driver. Options are available to you, and it is a good idea to talk with a skilled Atlanta accident attorney to find out your rights to recovery and what options may be available for your specific case.
